And by promoting various types of criminal activities, public peace can be disturbed in the district by influencing mutual enmity on the basis of communalism, caste-hatred, political rivalry, regionalism etc. Said that there is also a possibility that various political parties/organisations/candidates/individuals may try to induce various types of inducements to the voters with the aim of influencing the fair and peaceful election process. In view of this, he has told that it is necessary to take immediate action to maintain public peace in the district to conduct the election process with fair, peaceful and transparent system. Prohibitory orders have been issued by District Magistrate Tehri Garhwal under the provisions of Section 144 of the Code of Criminal Procedure, 1973.
In the order issued by the District Magistrate, it has been said that no meeting or meeting will be organized in any public place under the district area without the prior permission of the Returning Officer/Assistant Returning Officer concerned.
No person shall form a group of five or more than five persons in any public place without permission and shall not join such groups. This restriction will not apply to the officers / employees on duty, cultural functions, students studying in educational institutions gathered for education and employees working in industries / units, business establishments, people gathered for business activities. Further, this condition shall not apply to the campaign which ends before 48 hours before the end of the poll.
Use of sound amplifying equipment for election campaign by any candidate / political party or their supporters. He will not organize or get rallies etc., nor will he make provocative slogans etc. Noise amplifying devices will be used near schools, hospitals and religious places.
No person shall in any manner use any weapon, knife, ball, stick, stick, ballam, other than Government servants engaged in the service of the duties of their office in the restricted area and the followers of Sikhism for whom it is a religious duty to wear swords, kirpans, etc. , spear, firearms such as guns, pistols or explosive substances such as petrol, acid etc Police personnel / Home Guard personnel deployed for security and peace and old, sick and handicapped persons will be free from this restriction for carrying sticks and sticks.
No person shall collect or cause to be hurled bricks, stones or objects to be hurled at any public place. No person/political party/candidate shall, during campaigning, use profane language which is detrimental to the integrity of India and Nor will he raise such slogans which are likely to hurt the sentiments of any particular person or disturb the peace. No person shall publish / cause to be published / broadcast any false rumors or news, nor will it be helpful in disseminating it through various social media mediums, so that the general public may have a feeling of hatred and malice towards different classes, sects, or There is a possibility of breach of peace.
No political party shall make any personal or any such objection with respect to any opposition party except by a critical review of its policies, programs and work done by it, which may affect the election process. No person or political party will provoke caste and religious sentiments etc. for the purpose of attracting votes. No person shall attempt or induce to force the closure of educational institutions, shops, public establishments etc. No person or political party will use religious places like temples, mosques, gurudwaras and churches etc. for campaigning.
No person shall shout slogans in public buildings, public places by any political party and according to the Uttarakhand Public Property Prevention Act, 2003, no public property shall be used for publicity through holding, posters, banners etc.
Vehicles being used for the campaign of candidates will not be allowed to carry more than the carrying capacity, keeping in view the convenience of the public and the ease of traffic, it will be necessary to provide the details of the vehicles to the Returning Officer/Assistant Returning Officer.
No political party and candidate shall intimidate or bribe anyone with the purpose of attracting votes, nor give gifts/money to favor him or organize food parties etc. No political party and The candidate shall not transport the voters on the polling day to their polling places and from their personal or other wishes.
Within 200 meters from all the polling stations set up in the district, no person other than the voter, candidate or election agent, the polling agent and the officer/employee police force working in peace related to election work will enter. Any kind of rally till 15 January 2022 to any political party candidate. Organizing events like road shows, processions etc. will not be allowed. After that, according to the instructions of the Election Commission, if permission is given for rally / road-show or meeting etc., then the political party / candidate will have to make arrangements for masks, sanitizers etc. during the meeting from their own resources. No person/political party/candidate etc. shall violate the COVID-19 instructions issued from time to time. During this period, political parties, organizations, candidates etc. are liable under the provisions of section 51-60 of the Disaster Management Act 2005 for violating the Kovid-19 guidelines, as well as being punished under section 188 of IPC. Since this case is of emergency in nature and it is not possible to give notice of Section-111 Cr.P.C. to individuals and groups of persons. Therefore, this order is being passed ex-parte in public interest. Violation of this order is punishable under section 188 of the Indian Penal Code, being not admissible under the relevant provisions and rules of other laws currently in force.
